There is hereby established a city cemetery to be known as the “Stockton City Cemetery.”

The City Manager shall appoint a Cemetery Superintendent or sexton, who shall have charge of the care, upkeep and maintenance of the City cemetery and all work in connection therewith. The Superintendent shall open and close all graves and see that all regulations in connection with the enclosure of lots and grave spaces and adornment of the cemetery are observed.

(a) A fee of $200 for the opening and closing on weekdays of any grave which includes a steel or concrete vault and a casket. For Saturday, Sunday or holidays the fee is $300.
(b) A fee of $100 for the opening and closing on weekdays of the grave site for a cremation burial. For Saturday, Sunday or holidays the fee is $150.
(c) A fee of $450 for disinterments made on weekdays only.
(d) A fee of $350 for reinterments made on weekdays only.
(e) All fees shall be paid to the City Clerk. All openings and closings will be made by and under the direct supervision of the Cemetery Superintendent.

(a) No monument, headstone or footstone of any kind shall be placed on any lot or grave space, or removed or relocated, without the direction and supervision of the Superintendent.
(b) Corner markers are not to be moved or removed for any reason.
(c) All monuments and their bases must be within the lot boundaries not extending over the lot line.

Hereafter the following charges shall be paid by the purchaser of cemetery lots:
(a) For each full lot (8 spaces): Residents -$400; Non-Residents - $800
(b) For each one-half lot (North or South only) (4 spaces): Residents - $240; Non-Residents - $480
(c) For each one-quarter lot (2 spaces): Residents - $150; Non-Residents - $300
(d) For each one-eighth lot (1 spaces): Residents - $100; Non-Residents - $200
Said fee includes permanent upkeep by the City.

Cemetery lots shall be conveyed by cemetery deed signed by the Mayor and countersigned by the City Clerk under the seal of the City, specifying that the purchaser to whom the same is issued is the owner of the lot or lots described therein, by number, as laid down on such map or plat, for the purpose of interment; and such cemetery deed shall vest in the purchasers, his or her heirs or assigns, a right in fee simple to such lot, for the sole purpose of interment, under the regulations of the City; and such deed shall be entitled to be recorded in the office of the register of deeds of the county without further acknowledgement; and such description of lots shall be deemed and recognized as a sufficient description thereof.

The Cemetery Superintendent shall be responsible for the keeping of an up-to-date plat of the cemetery, showing the ownership of all lots and blocks, the streets and alleys.

The city clerk shall be responsible for the sale of all lots and cemetery deeds and shall keep appropriate records thereof.

If any person or persons desire to transfer ownership of any lot or part of a lot, the deed shall be surrendered to the City Clerk and a new deed shall be issued.

No fence, hedge, or curbing or other obstructions shall be placed around or in the lot which would hinder in the mowing or care of the lot. No trees or shrubs may be planted without the permission of the Cemetery Superintendent. Plants and shrubs must be contained inside the lot boundaries.

It shall be unlawful to bury any deceased human body within the corporate limits of the City except in a cemetery.

Metal graveliner or a concrete box liner will be required for all buried in the Stockton City Cemetery.

No person or persons shall enter inside the enclosing fence, or be on the premises between the hours of sunset and sunrise, without the permission of the superintendent, chief of police, city manager or mayor.

The following burial limits shall apply to each individual burial space:
(a) One adult casket and one cremation urn;
(b) One infant casket and one cremation urn;
(c) No more than two (2) cremation urns;
(d) Stacking of caskets is not permissible.
