ARTICLE 1. POLICE DEPARTMENT

The police department of the city shall consist of regularly appointed law enforcement officers, one of whom shall be chief of police and such other necessary members as may be appointed by the city manager from time to time.

The chief of police shall have general charge and control of the police department. In the discharge of his or her duties, the chief of police shall be subject to the orders of the city manager and shall perform such other duties as are prescribed or authorized by law or ordinance and as may be assigned by the city manager. All other law enforcement officers shall perform the duties and exercise the powers as are prescribed or authorized by law or ordinance or as may be assigned to them by the chief of police.

Law enforcement officers while on duty shall devote their time and attention to their respective duties according to the laws of the city and of Kansas. It shall be their general duty at all times to the best of their ability to preserve good order, peace, quiet and to enforce the laws of the city and of Kansas throughout the city. It shall be their further duty to arrest all persons found at any time, day or night, in the act of violating any such law, or aiding or abetting any such violation. They shall make complaint against any and every person so arrested and shall cause such person to be brought to trial.

The chief of police shall at all times have power to make or order an arrest with proper process for any offense against the laws of the city or of Kansas and to arrest without process in all cases where any such offense shall be committed in his or her presence. All law enforcement officers of the city shall have power to arrest all offenders against the laws, by day or by night, in the same manner as the chief of police and keep them in the city jail or other safe place to prevent their escape, until a trial can be had before the municipal court or other court having jurisdiction of the offense alleged.

(a)   Purpose. This section is established for the benefit of the residents of Stockton, Kansas. The City of Stockton is the governing body responsible for the funding of the police department that obtains fingerprints. This section is designed to establish fees to cover fingerprinting costs incurred by the Rooks County Sheriff’s Department.

(b)   Scope. This section establishes a booking or processing fee for each criminal complaint filed in the Stockton Municipal Court and as set forth in K.S.A. 12-16,119, to be assessed as separate court costs. Such fees are in addition to and not substitute for any and all fines and penalties otherwise imposed by the offense by which the person is charged. The following fees will be collected by the Stockton Municipal Court when fingerprinting is required and upon collection the fee will be paid to the Rooks County Sheriff’s Department.

(c)   Fees.

(1)   Adults    $45.00

(2)   Juveniles $25.00
