Unless otherwise specified, violations of the provisions of this article shall be punishable as set out in Article 20 of the Standard Traffic Ordinance incorporated in section 14-101 of this chapter.

It shall be unlawful for any person to drive or operate a vehicle upon a highway, street or alley in a careless or heedless or an inattentive manner, or without due caution and circumspection, or in any manner not constituting reckless driving but so as to endanger or be likely to endanger any person or property.

(a)   Every parent or legal guardian of a child under the age of four years who resides in Kansas, and who is transporting such child in the front seat area of a passenger car, as defined in K.S.A. 8-1445, on any street or highway within the city, shall provide a child passenger safety restraining system of a type approved by the Kansas secretary of transportation.

(b)   Any person convicted of a violation of this section shall be punished by a fine of $10 per occurrence.

(c)   The fine provided for in subsection (b) shall be waived if the parent or legal guardian provides proof prior to his or her trial before the municipal court that he or she has purchased or acquired an approved child safety restraining system.

In accordance with the provisions of this chapter, and when signs are erected giving notice thereof, drivers of vehicles shall stop or yield as the sign directs at every intersection before entering any of the following streets or parts of streets, which are hereby designated through streets:

(a)   Main Street from each city limits to west city limits;

(b)   Cedar Street from south city limits to north city limits.

(a)   This section pertains only to vehicles of a commercial nature. A commercial vehicle for the purpose of this section is a motor vehicle which is used for transporting goods or passengers for business or commercial purposes. This includes, without limitations, semi-trucks, truck trailers or truck trailer vehicle combinations units (hereinafter commercial vehicles.) Vehicles tagged for farm use and used for transporting agricultural commodities, supplies or equipment are exempt from this section.

(b)   No person shall drive, pull or operate any commercial vehicle on any paved, macadamized or hard surface street located and maintained by the City of Stockton, Kansas which is located in a residentially zoned area, except:

(1)   All commercial vehicles entering, operating within or passing through a residentially zoned area in the City of Stockton, Kansas shall use only the following streets:

(A)  Highways 24 and 183

(B)  Walnut Street, from South 4th to Main Street

(C)  North 3rd, from Pine Street to Oak Street

(D)  Oak Street, from South 4th to Main Street

(E)   Oak Street, from North 3rd to Main Street

(F)   Hendricks Street, from North 3rd to Main Street

(c)   Freight trucks having a destination in the city limits may make deliveries on non-designated streets provided such deliveries are completed in a reasonable length of time and are expressly for loading and unloading only. Trucks carrying construction related materials may have access to properly permitted construction sites inside city limits using city streets.

(d)   It shall be unlawful to park or leave unattended any commercial vehicle on any street within the City of Stockton which is zoned residential unless such vehicle is being loaded or unloaded under the parameters as described in subsection (c) or on Highways 24 and 183.

(e)   Any person violating the provisions of this section shall be subject to a penalty of not more than $100 and any towing costs associated with the violation.

In accordance with the provisions of this chapter, the following intersections not on through streets are hereby designated as yield intersections and when signs are erected at one or more entrances as stated, the drivers of vehicles shall yield before entering the intersection:

(a)   Intersection of south First Street and Walnut Street at east and west entrances;

(b)   Intersection of south Second Street and Walnut Street at east and west entrances;

(c)   Intersection of Cypress Street and north First Street at each entrance.

(a)   It is unlawful for the driver of any vehicle to use or cause to be used or operated within the city any mechanical exhaust or engine device designed to aid in the braking or deceleration of any vehicle which results in the excessive, loud, unusual or explosive noise from such vehicle, or otherwise known as Jake braking.

(b)   Any person convicted of a violation of this section shall be punished according to Article 20, Section 201 of the Standard Traffic Ordinance for Kansas Cities.
