A CHARTER ORDINANCE CHANGING THE NUMBER OF CITY COMMISSIONERS IN AND FOR THE CITY OF STOCKTON, KANSAS; PROVIDING FOR THE FILLING OF VACANCIES THEREBY CREATED; ESTABLISHING THEIR TERMS OF OFFICE; EXEMPTING THE CITY OF STOCKTON, KANSAS FROM K.S.A. 12-1005e. AND K.S.A. 15-1302; AND REPEALING CONFLICTING PORTIONS OF CHARTER ORDINANCE NO. 2 AND THE CITY CODE. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF STOCKTON, KANSAS:

SECTION 1. The City of Stockton, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby changes and increases the number of its city commissioners from three (3) to five (5). There is hereby established a five (5) member Commission for the City consisting of five (5) positions numbered 1 through 5. Candidates for City Commission shall file for election to one of the numbered positions open for election.

SECTION 2. Initially, the two (2) positions created by this charter ordinance shall be filled by a special election called for such purpose. A copy of this charter ordinance calling for such special election shall be delivered to the county election officer immediately upon this ordinance taking effect. The special election shall be conducted as soon as possible thereafter.

SECTION 3. The initial terms of office for the two (2) positions created by this charter ordinance shall be staggered, i.e. position #4 shall be for a term of two (2) years and position #5 shall be for: a term of three (3) years. After the initial term of office, all city commission positions shall be for three (3) year terms and shall expire on a rotating or staggered basis, so that no more than two commissioners shall be elected in any given year. In 1994 position #1 will be elected; in 1995 positions #2 & #4 will be elected; and in 1996 positions #3 and #5 will be elected. All elections will be conducted in accordance with Chapter VI, Article I of the City Code.

SECTION 4. The City of Stockton, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby exempts itself from and makes inapplicable to it the provisions of K.S.A. 12-1005c and K.S.A. 15-1302 establishing the terms of office for city commissioners. The provisions of this charter ordinance set forth above are substituted for the provisions of those statutes.

SECTION 5. Portions of Charter Ordinance No. 2 and Chapter I, Article 2, Section 1-201 of the City Code which conflict with this charter ordinance are repealed.
